General Warranty Conditions for Ferrel Trailers

These warranty terms apply to all products bearing the Ferrel brand and manufactured by AS Ferrel (hereinafter referred to as the “Manufacturer”).

1. Warranty Coverage and Period

1.1. The Manufacturer grants a limited warranty for a period of 12 (twelve) months from the date the product is handed over to the Buyer (delivery date).
1.2. Steel structures and components manufactured by the Manufacturer are covered by an extended limited warranty of 24 (twenty-four) months from the delivery date.
1.3. The extended warranty applies exclusively to steel structures and components manufactured by the Manufacturer and does not extend to other components unless expressly agreed in writing.
1.4. Upon expiration of the applicable warranty period, all warranty obligations of the Manufacturer shall automatically terminate.

2. Warranty Procedure and Notification Obligation

2.1. The Buyer must notify the Manufacturer in writing of any defect no later than 5 (five) calendar days after discovery of the defect.
2.2. The notification must include:

  • Product name and VIN or serial number.

  • A detailed description of the defect.

  • Clear photographs of the trailer and detailed view of the defective part.

  • Documentation indicating the delivery date of the machine.

2.3. Failure to comply with the notification deadline or documentation requirements
may result in rejection of the warranty claim.
2.4. The Manufacturer shall examine the reported defect within 14 days of receiving complete documentation.
2.5. If the Manufacturer determines that the defect is due to a manufacturing or design fault, the Manufacturer shall, at its sole discretion:

  • Repair the defective part; or

  • Replace the defective part.

2.6. Repair or replacement shall be carried out as soon as reasonably possible, but no later than 30 (thirty) days after the warranty claim has been approved.
2.7. The Manufacturer reserves the right to authorize the Buyer, in writing, to replace defective parts independently.

3. Location of Warranty Repairs and Costs

3.1. Warranty repairs shall be carried out in one of the folllowing locations:
3.1.1. at the Manufacturer’s premises, Põllu 3, Sõmeru, 44201, Estonia;
3.1.2. at the authorized importer’s premises;
3.1.3. at the authorized dealer’s premises;
3.2. All transport costs to and from the repair location shall be borne by the Buyer.
3.3. Transportation costs of the defective part or component to the repair location will be beared by the Manufacturer.
3.4. Warranty repair labor costs shall be reimbursed by the Manufacturer at a rate not exceeding 60 € per hour.
3.5. For warranty repairs carried out outside the Manufacturer’s premises, the
Manufacturer shall determine and communicate the standard (nominal) repair
time applicable to each type of repair. Reimbursement shall be calculated based on the nominal repair time specified by the Manufacturer multiplied by the approved hourly rate regardless of the actual time spent.
3.6. If, upon inspection, the defect is determined not to be covered by warranty, all inspection, repair, and transport costs shall be borne by the Buyer.

4. Exclusions from Warranty

The warranty does not cover defects or damages resulting from:

  • Normal wear and tear.

  • Improper installation, connection, or commissioning.

  • Characteristics or properties of transported or loaded materials. 

  • Use contrary to technical specifications, safety requirements, or intended purpose.

  • Failure to comply with the user manual, including maintenance requirements.

  • Use of spare parts or components not approved by the Manufacturer.

  • Unauthorized modifications, alterations, or repairs.

  • Mechanical damage, misuse, negligence, accidents (including fire or traffic accidents), force majeure, or other external factors.

  • Any increase in damage that the Buyer could reasonably have prevented

5. Termination of Warranty

The warranty shall become void prior to expiration if:

  • The product is used for purposes other than those intended.

  • The product is modified, altered, or repaired without prior written approval from the Manufacturer.

  • The product has not been properly maintained in accordance with the user

manual.

6. Replaced Parts and Components

Any part repaired or replaced under warranty shall remain covered only for the
remainder of the original warranty period applicable to the product.
The replacement of a part does not extend or renew the overall warranty period.

7. Limitation of Liability

7.1. The Manufacturer’s liability under this warranty is strictly limited to the repair or replacement of defective parts as described above.
7.2. The Manufacturer shall not be liable for:

  • Indirect or consequential damages.

  • Loss of profit, loss of business, or loss of production.

  • Downtime or third-party claims.

  • Any contractual obligations assumed by the Buyer towards third parties.

7.3. This warranty constitutes the sole and exclusive warranty provided by the
Manufacturer unless otherwise agreed in writing.
